                        <title>Search Warrants Result in Seizure of Firearms and Drugs</title>

                        <guid>https://hamiltonpolice.on.ca/news/search-warrants-result-in-seizure-of-firearms-and-drugs/</guid><pp:caseid>655812</pp:caseid><description><![CDATA[<img src="https://content.presspage.com/uploads/2189/42284253-2c2f-4c9b-9231-1fc3c170b947/1920_newsrelease-aug24-2024guns1.jpg?10000"><p>Hamilton Police continue to put pressure on those individuals and organizations dealing drugs in our community.</p><p>A Hamilton Police Major Drugs and Gangs Unit investigation led to the seizure of a large amount of cocaine, MDMA, oxycodone, illicit cannabis, psilocybin, as well as a large amount of cash and numerous firearms.</p><p>“We are committed to tackling gun violence and drug trafficking in our City. These issues threaten the safety of our neighbourhoods and the well-being of our residents. Our members are dedicated to getting these criminals off the streets and continuing to make Hamilton a safe place for everyone,” said Chief Frank Bergen.</p><p>On August 22, 2024, warrants were executed at an Ancaster residence, rural Burlington property and a motor vehicle. As a result, Police seized the following illicit drugs:</p><ul><li><span>Over one kilogram of cocaine</span></li><li><span>Approximately seven kilograms of MDMA</span></li><li><span>33 kilograms of processed cannabis</span></li><li><span>Over 250 grams of psilocybin</span></li><li><span>Over 2,500 oxycodone pills</span></li></ul><p>The street value of the seized drugs is estimated to be $632,685.</p><p>Police also seized the following:</p><ul><li><span>A large amount of cash, estimated to be between $200.000 - $250,000</span></li><li><span>A 9 mm Prohibited handgun</span></li><li><span>A .45 caliber handgun</span></li><li><span>Ammunition</span></li><li><span>A conducted energy weapon</span></li></ul><p>Further, Police seized another restricted firearm and four non-restricted firearms to be held for a firearms prohibition hearing.</p><p>As a result of the investigation Nikolas Deschenes, a 34-year-old Ancaster man, was arrested and faces the following criminal charges:</p><ul><li><span>Unauthorized Possession of a Firearm</span></li><li><span>Possession of Prohibited Firearm</span></li><li><span>Possession Contrary to Order</span></li><li><span>Possession Contrary to Order</span></li><li><span>CDSA 5(2) – Possession for the Purpose of Trafficking – Cocaine</span></li><li><span>CDSA 5(2) – Possession for the Purpose of Trafficking - MDMA</span></li><li><span>CDSA 5(2) – Possession for the Purpose of Trafficking - Oxycodone</span></li><li><span>Cannabis Act 9(2) – Possession of Cannabis for the Purpose of Distributing</span></li><li><span>Cannabis Act 10(2) – Possession of Cannabis for the Purpose of Selling</span></li><li><span>Proceeds of Crime Over $5,000</span></li></ul><p>A 31-year-old Burlington male is being sought by police and will be charged with the following:</p><ul><li><span>Careless Storage of a Firearm</span></li><li><span>Possession of Prohibited Weapon</span></li><li><span>CDSA 5(2) – Possession for the Purpose of Trafficking – Psilocybin</span></li></ul><p><span>Anyone with any information in regards to this investigation can contact Detective Sergeant Steve Bereziuk of the Major Drugs and Gangs Unit at 905-546-3887.</span></p><p><span>&nbsp;Anonymous tips can also be submitted through Crime Stoppers at 1-800-222-8477 or online at </span><a href="http://www.crimestoppershamilton.com"><span>http://www.crimestoppershamilton.com</span></a><span>.</span></p>]]></description><category><![CDATA[Case Number: 24-635872,Media,warrant,Firearms]]></category>

                        <title>Update: Arrest Warrant Issued in Kinrade Avenue Shooting</title>

                        <guid>https://hamiltonpolice.on.ca/news/update-arrest-warrant-issued-in-kinrade-avenue-shooting/</guid><pp:caseid>634132</pp:caseid><description><![CDATA[<p><span>Detectives from the Shooting Response Team (SRT) have made significant progress into the shooting investigation that took place on Monday, May 13, 2024, in the alleyway area of Kinrade Avenue and Barton Street East.</span></p><p><span>The driver of the Nissan vehicle involved in the incident, who returned fire during the exchange, has been identified as Malcolm Davis, 25, of Hamilton. After striking two other vehicles in an attempt to flee, Davis crashed the vehicle near Gibson Avenue and fled the scene on foot.</span></p><p><span>An arrest warrant has been issued for Malcolm Davis, who is wanted for the following offences:</span><br><br><span style="padding:0in;"><strong>Discharge with Intent</strong></span><span> - Section 244(1) of the Criminal Code, for shooting a firearm at an unknown person on May 13, 2024.</span><br><span style="padding:0in;"><strong>Reckless Discharge of a Firearm</strong></span><span> - Section 244.2(1)(b) of the Criminal Code, for recklessly endangering the safety of others in the area of Cannon Street East and Kinrade Avenue on May 13, 2024.</span><br><span style="padding:0in;"><strong>Unauthorized Possession of a Firearm</strong></span><span> - Section 91(1) of the Criminal Code, for possessing a handgun on May 13, 2024.</span><br><span style="padding:0in;"><strong>Knowledge of Unauthorized Possession of a Firearm</strong></span><span> - Section 92(2) of the Criminal Code, for knowing he was not authorized to possess a handgun on May 13, 2024.</span><br><span style="padding:0in;"><strong>Possession of a Prohibited Firearm - Loaded</strong></span><span> - Section 95(1) of the Criminal Code, for possessing a loaded prohibited firearm on May 13, 2024.</span><br><span style="padding:0in;"><strong>Failure to Stop After an Accident</strong></span><span> - Section 320.16(1) of the Criminal Code, for failing to stop after colliding with a blue Hyundai motor vehicle at 33 Gibson Avenue on May 13, 2024.</span><br><span style="padding:0in;"><strong>Failure to Stop After an Accident</strong></span><span> - Section 320.16(1) of the Criminal Code, for failing to stop after colliding with a yellow Fiat motor vehicle at the intersection of Wilson Street and Gibson Avenue on May 13, 2024.</span><br><span style="padding:0in;"><strong>Dangerous Operation</strong></span><span> - Section 320.13(1) of the Criminal Code, for operating a motor vehicle on Cannon Street East while shooting a firearm out of the window, fleeing at high speed, and crashing into two motor vehicles on May 13, 2024.</span><br><span style="padding:0in;"><strong>Possession Contrary to Order</strong></span><span> - Section 117.01(1) of the Criminal Code, for possessing a firearm on May 13, 2024, while prohibited by an order issued on December 18, 2018, by Justice Zivolak.</span><br><span style="padding:0in;"><strong>Possession Contrary to Order</strong></span><span> - Section 117.01(1) of the Criminal Code, for possessing a firearm on May 13, 2024, while prohibited by an order issued on January 19, 2022, by Justice E.J. Lainevool.</span></p><p><span>Malcolm Davis should be considered armed and dangerous. The male arrived in a red sports utility vehicle, parked at the side of the building, entered the store in disguise and robbed the clerk by indicating he had a gun. A firearm was seen. An undisclosed amount of cash was taken and the suspect fled in the SUV. The clerk did not sustain any physical injuries.</span></span></span></p><p><span><span><span>On November 23, 2020, at approximately 6:00 a.m., the male described earlier arrived at another variety store located on Upper Wellington Street in the same SUV. The male indicated he had a firearm and robbed the clerk of an undisclosed amount of cash. He fled in the SUV and the clerk did not sustain any physical injuries.</span></span></span></p><p><span><span><span>Through continued investigation, a Hamilton man was identified as being responsible for the robberies and on Monday, December 21, 2020, plainclothes officers attended a residence on the West Mountain. The male was arrested without incident after exiting his residence.</span></span></span></p><p><span><span><span>On Tuesday, December 22, 2020, search warrants were granted for the suspect&rsquo;s residence and vehicle. Investigators located evidence related to the robbery inside the residence. <p><span><span><span>On Monday, July 27, 2020, shortly before 1:30 p.m., Hamilton Police observed a white BMW sedan in front of a residence in the area of Wellington Street North and Wilson Street. At that time, two male occupants exited the vehicle and entered the residence. An investigation into the status of the vehicle revealed the licence plates were recently reported as stolen. A few moments later, one of the males returned to the vehicle, opened the trunk and removed another set of licence plates. He was arrested without incident, the second male noted the presence of police and fled back into the residence. During the search of the residence police located another male hiding. He was found to be in possession of an airsoft handgun and flare gun with active flares. He was arrested after police learned there was a warrant for his arrest. The male who fled into the residence was able to escape through a rear exit. Police continue to work on establishing his identity.</span></span></span></p>

<p><span><span><span>As police continued the investigation of the male at the BMW, they located evidence to support the trafficking of illicit drugs. The male was advised he would be facing additional drug-related charges.</span></span></span></p>

<p><span><span><span>In June of 2020, Hamilton Police began a drug investigation into illicit drug activity at local hotels. Their investigation led them to a suspect they believed was dealing large amounts of illicit narcotics.</span></span></span></p>

<p><span><span><span>On Friday, June 19, 2020, search warrant was granted in regards to a hotel room located at a hotel in the area of the QEW and Centennial Parkway North.</span></span></span></p>

<p><span><span><span>A short time later, police were in the hotel parking lot observing the suspect&rsquo;s vehicle. They observed the suspect and a second male inside this vehicle<span>.</span> The parties were arrested without incident. A search of one male revealed he was in possession of illicit drugs and the second male was in possession of cash.</span></span></span></p>

<p><span><span><span>A search of the vehicle also recovered a number of illicit drugs and two prohibited weapons.</span></span></span></p>

<p><span><span><span>Hamilton Police Vice and Drug investigators then attended the hotel room where the suspect was staying and executed the search warrant. Inside, police located illicit drugs, cash and additional evidence to support drug trafficking.</span></span></span></p>

<p><span><span><span>The investigation resulted in the seizure of over $29,000 in Canadian currency and illicit drugs with a street value of $82,580.</span></span></span></p>

                        <title>Police and Bylaw Execute Warrant at Pop-Up Scrap Yard </title>

<p>On April&nbsp;16, 2020, Hamilton Police executed a search warrant at a Wentworth Street North commercial property in Hamilton. The pop-up scrap metal business was buying stolen scrap metal and selling it at a later date out of sea containers and concrete outbuildings during a 24/7 operation.</p>

<p>Police launched an investigation when concerns developed about non-conventional business practices performing&nbsp;within the confines of the property. When Police and City Bylaw&nbsp;executed a search warrant they identified several Bylaw and Criminal offences were occurring.</p>

<p>At the time, 14 people were located living inside sea containers when officers discovered evidence of drug use, $10,000 worth of&nbsp;stolen property, three wanted parties and a male breaching court conditions. The grounds were littered with garbage and unkempt items while operating as an unlicensed business.</p>

                        <title>Police Looking to Arrest Keith Street Shooter</title>

A warrant for his arrest has been obtained.</p>

<p>On February 25, 2020, shortly after 9:30 a.m., a male and female sleeping inside their Keith Street residence awoke to someone knocking at their front door. A&nbsp;male entered the home and engaged in an argument with the male resident which led to him being shot in the leg. The suspect left the area in a vehicle. This is considered to be a targeted incident.</p>

<p>The victim was transported to the hospital with non-life threatening injuries.</p>

<p>Police have identified the outstanding suspect as Marlin Wilson of Stoney Creek. The firearm has not been located and he is considered to be armed and dangerous. Wilson is known to move in and out of neighbouring GTA communities with ties to Toronto.</p>

They are scheduled to appear in court later today.</p>

<p>Members of the Hamilton Police Gangs and Weapons Enforcement Unit commenced an investigation focusing on a mountain residence and its occupants.</p>

<p>On Wednesday, February 19, 2020, an application for a Controlled Drugs and Substance search warrant was submitted to the courts. The warrant was granted the same day for a residence in the area of the Red Hill Valley Expressway and Mud Street West as well as two associated vehicles.</p>

<p>Shortly after 12:00 p.m., a male related to the identified residence was observed operating a vehicle in the area of Stone Church Road and Upper Ottawa Street. With assistance from the Emergency Response Unit he was arrested without incident and taken into police custody. While conducting the arrest procedure, police located a mixture of fentanyl and heroin. A short time later, the second party related to the identified residence returned and she was arrested without incident. During the execution of the warrant, police located loaded firearms, illicit drugs and other evidence to support the trafficking of illicit drugs. All items were seized as evidence and lodged for court proceedings.</p>

<p>A 29-year-old Hamilton man and 33-year-old Hamilton woman are scheduled to appear at the John Sopinka Courthouse later today to answer to several criminal charges.</p>

                        <title>Grimsby House Busted for Drug Trafficking</title>

A male and female with ties to the address have been arrested and charged with several criminal offences.</p>

<p>On February 12, 2020, shortly after 11:30 a.m., police observed a male and female exit from a home known for trafficking Methamphetamine. The couple left in a pick-up truck and drove to Lake Street and Bartlett Street in Stoney Creek where they were stopped and placed under arrest. They were both transported back to Central Custody and charged with multiple drug offences with their bail opposed.</p>

<p>Later that afternoon police executed a search warrant at the Grimsby residence and located drugs, stolen property and Canadian Currency.</p>

<p>On January 31, 2020, police conducted a drug warrant in an outbuilding in the area of Mohawk Road West and Garth Street in Hamilton. The building had been renovated into an apartment type residence. During the search, police located a couple living inside with evidence of drug trafficking. Police also located a 22 calibre handgun, ammunition, drugs and Canadian Currency.</p>

                        <title>Hamilton Man Faces Multiple Internet Child Exploitation Charges</title>

<p>In February 2019, the Hamilton Police Service Internet Child Exploitation (ICE) Unit began an investigation into an individual in possession of child pornography. The male suspect was identified as residing in Hamilton and a search warrant was executed at his dwelling on Thursday, October 31, 2019, by members of the Hamilton ICE Unit, Technological Crime Unit and Division 10 Uniform Patrol.</p>

<p>A 37-year-old male was arrested, charged and brought before the courts. A forensic examination of devices capable of storing digital media is ongoing and it is possible that further charges may be filed.</p>

<p>In September of 2019, the Hamilton Police Service &ndash; Internet Child Exploitation Unit (ICE) initiated an investigation after being contacted by the security department of a local business wishing to report one of their employees.</p>

<p>A search warrant was executed and a number of devices capable of storing digital media were seized. Investigators categorized the media files and found that the suspect was in possession of over 500 digital media files of child pornography.</p>

<p>The suspect was arrested on Monday, October 28, 2019, and was later released on a recognizance of bail.</p>

                        <title>Arrest Made in Car Entry Investigations</title>

One suspect has been arrested and the second suspect identified.</p>

<p>On Monday, August 5, 2019, between 10:00 p.m. and 10:50 p.m., two males broke into an apartment building located at 10 Village Green Boulevard. They attended the underground parking lot and entered several vehicles, stealing various personal items. Security cameras captured the males entering the lobby.</p>

<p>Hamilton Police was notified of the incident the following morning. The scene was processed and evidence was collected.</p>

<p>Through investigation, the suspects were identified. Surveillance video is believed to have assisted in identifying the suspects.</p>

<p>On Sunday, August 11, 2019, shortly before 8:00 p.m., one of the theft suspects was involved in an altercation at Center Mall located at 1149 Barton Street East. As a result of that incident, he was arrested and the warrant for this arrest related to the vehicle entries was executed.</p>

<p>He was taken into police custody and is scheduled to appear in court later today.</p>

<p>The second suspect has been identified and he is currently in police custody. He will be brought before the courts in the coming days.</p>

<p>The investigation into other car entry thefts remains open and there is a potential for additional charges.</p>

<p>On Wednesday, July 17, 2019, Hamilton&nbsp;Police applied for and was granted a search warrant for a residence in the area of for Cannon Street East and Sherman Avenue North.</p>

<p>Shortly after 4:30 p.m., Andrew Erneston was observed exiting the residence and was arrested. He was found to be in possession of a&nbsp;<span>conducted energy weapon and an undisclosed amount of Canadian currency.&nbsp; A short time later, members of the Gangs Weapons Enforcement,&nbsp;Vice and Drugs and Emergency Response Units entered the residence and executed the search warrant. Brittany Lupton was located inside the residence and was found&nbsp;to be in possession&nbsp;of Fentanyl and a prohibited weapon. </span></p>

<p>Hamilton Police and Niagara Regional Police have been involved in a joint project since the fall of 2018 into the criminal activity of a 49-year-old Niagara man.</p>

<p>On Wednesday, April 17, 2019, Hamilton Police BEAR Unit, Ground Search Unit and&nbsp;Niagara Regional Police Detectives attended the West Lincoln address and executed a search warrant. The search of the large rural property included three separate residences a large garage and seven outbuildings.</p>

<p>One separate male on the property was arrested on an outstanding warrant with Niagara Regional Police and Hamilton Police Service.</p>

The male became assaultive towards police but was eventually taken into custody. Police learned a Canada-wide warrant existed for his arrest. He is now facing new charges.</p>

<p>On Wednesday, March 27, 2019, shortly after 10:00 a.m., Hamilton Police responded to a call for an unwanted guest at a residence located in the area of Grandville Avenue and Violet Drive. Preliminary information provided to police described a male was originally allowed to stay at the residence for approximately two weeks but when the owner asked him to leave he refused.</p>

<p>Once on scene, officers were informed by the owner that the male had become agitated and paranoid so they determined it would be better if he left and after making multiple requests for him to leave, contacted police.</p>

<p>Hamilton police engaged the male who refused to respond to their numerous requests for him to leave. He was arrested under the Trespass to Property Act, for failing to leave the premise when directed. During the arrest procedure, the male became assaultive towards police. He was eventually secured and taken into police custody.</p>

<p>Throughout the entire process, the male refused to identify himself. Police officers&nbsp;were later able to confirm his identity and learned there was a Canada-wide warrant for his arrest.</p>

<p>The male who is of no fixed address will appear today at the John Sopinka Court House to answer to the charges.</p>

                        <title>Impaired Driver Arrested, Warrant Executed, Cocaine Seized at Traffic Stop</title>

The investigation revealed the driver was impaired,&nbsp;the passenger had two outstanding warrants for&nbsp;his arrest and cocaine was present in the vehicle. The vehicle occupants were&nbsp;arrested and the&nbsp;cocaine seized as evidence.&nbsp;</p>

<p>On Thursday, February 21, 2019, shortly after 1:30 a.m., a Hamilton Police officer was on proactive patrol in the area of King William Street East and Emerald Street North. At that time the officer&rsquo;s attention was drawn to a Red Chevrolet Uplander minivan that was stopped at the intersection on a green light. A male was observed standing at the driver&rsquo;s side window conversing with the driver. A preliminary investigation revealed the registered owner of the vehicle was a suspended driver. The vehicle proceeded to drive off and a short distance away a traffic stop was conducted. As police conversed with the driver they learned he was the registered owner. Further investigation revealed he was under the influence of alcohol. The driver was arrested without incident for driving while suspended and impaired operation of a motor vehicle.</p>

<p>Police located a male sitting in the rear of the van, not wearing his seatbelt. Being in violation of the Highway Traffic Act, police requested he identify himself. The male refused and was arrested. During the search of the male, police located items which suggested possible drug activity. Eventually, identification was located for the male and the subsequent investigation into his identity revealed outstanding arrest warrants with Peel Regional and the Hamilton Police. Additionally, he was also bound by court orders which he was violating.</p>

<p>A search of the cabin area between the driver and passenger resulted in police locating an undisclosed amount of cocaine.</p>

<p>The passenger was taken into police custody and held for a bail hearing.</p>

<p>The driver was taken into police custody and later released. He will appear in court on Tuesday, March 19, 2019, to answer to the driving-related charges and Wednesday, March 20, for the drug charge.</p>

<p>The motor vehicle will be impounded for a seven day period.</p>

<p>The cocaine was seized as evidence.</p>

<p>On November 21, 2018 shortly after 5:30 a.m., Hamilton Police executed a search warrant on an apartment on James Street South. Police conducted a search and located $500 worth of cocaine and a large quantity of Canadian Currency. During the search, PSD Chase brought attention to a piece of furniture in the residence. When officers dismantled the unit, they discovered over $50,000 concealed in a secret compartment.</p>

<p>The male occupant was arrested and held for a bail hearing. The female resident was released with a Promise to Appear at a future date.</p>

<p>As a result of our investigation Gabe Sciarra was arrested leaving his residence, he was found in possession of a quantity of methamphetamine, cocaine, and drug paraphernalia related to the sale of drugs.</p>

<p>Police then executed a search warrant on his residence and located a quantity of drugs including crystal meth, cocaine and magic mushroom. In addition police seized 10 firearms and a large quantity of stolen property including a steel palm tree that had been reported to the media.</p>
