Hamilton Lawyer Arrested for Misappropriation of Trust Funds

On Wednesday, September 12, 2018, Detectives from the Hamilton Police Major Fraud Unit arrested Mr. John Wallace Findlay (64 yrs. of age) for misappropriating trust funds that were held for disbursements to plaintiffs in the Caledonia Class Action lawsuit.

In June 2011, a class action law suit against a number of parties including the Ontario Provincial Police and the Province of Ontario was settled for $20 Million.

As plaintiff’s counsel, Mr. Findlay was responsible for the appropriate management and distribution of the settlement monies. After the original disbursements, there were approximately $2.2 million in reserve funds in 2013.

On May 29, 2017, Mr. Findlay reported himself to the Law Society of Ontario after having used the trust money.

John Wallace Findlay was charged with Criminal Breach of Trust, Theft Over $5000 and Fraud Over $5000. Mr. Findlay was released on a Promise to Appear and is scheduled to appear in court on September 25, 2018.
